OGDEN, Utah (ABC4) — A father was arrested for child abuse homicide following the death of his infant daughter, according to arrest documents.

Nicholas James Horsley, 27, was arrested on one count of child abuse homicide, a first-degree felony; and one count of endangerment of child or vulnerable adult, a third-degree felony.

According to an affidavit of probable cause filed in Weber County, officials with the Ogden Police Department responded to an unresponsive infant on Dec. 27, 2024, and found Horsley’s 4-month-old daughter not breathing.

The child was taken to an area hospital after officials started life-saving measures at the scene. Life-saving attempts continued at the hospital, but the child did not survive her injuries.

“Medical scans revealed that [the infant] had sustained a catastrophic brain bleed which was caused by non-accidental Abusive Head Trauma,” the affidavit reads.

According to the affidavit, the investigation revealed only the parents “had care and custody” of the 4-month-old during the period when the trauma would have been caused.

The mother of the child reported that Horsley took the infant into another room on the night of the incident and returned about 10 to 20 minutes later with the “completely lifeless” infant, according to the affidavit.

There were two other children in the home — a 6-year-old and an 18-month-old — who both reportedly had access to controlled substances including marijuana.

Horsley was arrested on Jan. 3, 2025, and booked into the Weber County Jail.

Charges are allegations only. All arrested persons are presumed innocent unless and until proven guilty beyond a reasonable doubt.
